Terms and Conditions

1. About these terms of sale

1.1 These Terms of Sale set out the terms and conditions that will apply when you place an order through www.1420th.org.uk/shop/.  If you are unable to understand, or have any questions about these Terms, please contact us (https://www.1420th.org.uk/shop/index.php?route=information/contact). You will be required to confirm that you have read and accept these Terms before you submit an order to us. Please note that these Terms are subject to change.

1.2 Trading information

Noah's Arc Online Shop

1.3 These Terms do not affect your legal (statutory) rights under your applicable national laws relating to the sale of consumer products.

1.4 The sales contract will be concluded in English language.

2. Order and acceptance

2.1 Each order submitted constitutes an offer to purchase products. Orders are subject to our acceptance and may be refused at our discretion, for example in cases where:

  1. orders cannot be processed due to an error in information you have provided;
  2. there is an error on the web shop relating to the products that you have ordered, for example an error relating to the price or description of the product as displayed on the web shop; or
  3. the products that you have ordered are no longer available through the web shop.

2.2 After we receive your order, you will receive an email confirming receipt of your order. If you do not receive an email, contact us before you try to place another order for the same product. You can log in to view or change your account information (i.e. incorrect email address supplied).

2.3 You will receive an email when your order is being dispatched confirming that your order has been accepted.

2.4 If you have any questions, comments or concerns regarding our order acceptance policy, or if you consider that your order was rejected in error, please contact us.

3. Product Information

3.1 We will have the right, at any time, to make changes to information about products displayed on the web shop, for example information about prices, description or the availability of products, and we may do so without first giving you notice of the changes. We will not, however, make any changes to the price, availability or description of any product after an order has been approved.

3.2 All items supplied are provided by 3rd party suppliers. Any dispute with regard to quality and defect you may have are with the 3rd party supplier and not with www.1420th.org.uk/shop.

3.3 We cannot guarantee that descriptions and images displayed within our shop are entirely accurate. Most images are displayed as a guide and not proof of design or manufacture.

3.4 It shall be the purchaser’s responsibility to assess the suitability of the goods for the purpose, for which they are to be used, and no guarantee or representation is given or to be implied as to the suitability of the goods for any particular purpose, even when the goods are manufactured to the purchaser’s special instructions.

4. Customer initiated order cancellations and changes

4.1 You can make changes to or cancel your order at any time before your order has been processed. To make changes to your processed order, please contact us. If your order has already been dispatched, you will only be able to request a refund of the product: please see Return Policy.

4.2 Personalised Products cannot be changed once the Order has been accepted.

5. Order tracking

You can track the progress of your order by logging into your account.

6. Delivery

6.1 In some cases some products might not be available for all countries. You will be informed of any such territorial restrictions before you can purchase the product.

6.2 Shipping and handling charges will depend on the size & weight of your order and the country to which the product is being shipped. Any customs duties or tariffs that may be imposed on the deliveries will be paid by you.

6.3 Any delivery dates provided to you in connection with your order are estimates. Although the aim is to provide you with as accurate estimates as possible, we cannot promise that they are accurate.

6.4 We reserve the right to deliver the ordered products in separate shipments.

6.5 Any product that is delivered to you will become your property at the time that you receive it provided that we have received full payment for the product. As soon as we have delivered the product to you, you will become responsible for it and for any loss or damage to it thereafter.

7. Prices and payment

7.1 The product price is always the price indicated in the web shop when you place your order. The price includes VAT where applicable.

7.2 Products and their postage are paid in conjunction with the order. The available payment methods are displayed in connection with the product order form in the web shop. Online payment methods are provided by PayPal.

8. Returns / Refunds

8.1 Refunds or exchanges in case of a faulty product

If you wish to exchange or return for a refund a product that is sold and delivered to you by us which is faulty or otherwise damaged when you receive it, or which does not correspond to the description on the web shop, you can do so in accordance with and pursuant to applicable law and Return Policy.

This provision does not set-aside your mandatory legal rights in this respect.

8.2 Refunds for non-faulty merchandise

You can exercise the right to cancel an order for product sold and delivered to you by us within fourteen (14) days from the date that the product is received in accordance and pursuant to the terms of Return Policy. The cost of return shipping is met by the customer. No refunds are given for the original shipping costs.

Items must be returned in 'As new' condition.

8.3 Returns and Refunds are not allowed in the case of accepted Product orders containing personalisation.

9. Liability to you

9.1 Nothing in these Terms will exclude or limit liability to you for fraud, death or personal injury or any other liability which the law states may not be excluded or limited.

9.2 We will not be liable to you under a contract for:

  1. any loss of profit, loss of income, loss of business, loss of revenue or loss of goodwill;
  2. any loss or corruption of or damage to data; or
  3. any loss or damage which was not a reasonably foreseeable result of either breach of a contract or breach of legal duty of care.

10. Personal information

When you create your Online Shop account and place an order through the web shop, you will be providing us with your personal information. We will use your personal information only to process your order and for the delivery of the products ordered and for other limited purposes. The collection and use of your personal information will be carried out subject to the terms of our Privacy policy.

11. General terms

The contract for sales of other products will be solely between you and www.1420th.org.uk/shop/ and is governed by the laws of UK.

If any provision of a contract is not valid or legally enforceable, that term will be deleted and the remaining terms will not be affected.

13. 3rd Party Trading

When an order is placed from a 3rd Party ("Member's Own" Category) your transaction is between yourself and the 3rd Party. Noah's Arc cannot be held responsible for loss, damage, maintenance or replacement of goods.
